Child custody is one of the most contentious aspects of family law. These cases appear in the California family courts every day, and they are all different. Nonetheless, the court does follow some uniform rules when deciding custody cases.

This means that visits take place in a controlled environment where a responsible adult is always available to take over. 

The court will also factor in geographical location. They are usually reluctant to make the child move long distances, away from established friend groups and schools, unless it is necessary. 

Safety is also a top priority for the family court. If there is any evidence of safety issues, then these will impact the custody ruling. For example, if either parent has a history of being physically or emotionally abusive. 

The best interests of the child are the deciding factor in all custody cases. Custody orders can be negotiated between parents, drawn up by the courts and even modified. However, this should always be based on the child’s best interests.
